Terms of Service
One flat monthly fee, a seat you can count on, and fair rules on both sides. These terms explain what we promise, what we ask of you, and how either of us can end the agreement.
1. About these terms
These terms apply when you use our website, book a commuter package, or arrange transport for your staff. By booking or using our services, you agree to them. If you are a business client and we sign a separate written agreement with you, that agreement takes priority where it differs from these terms.
Nothing in these terms limits the rights you have as a consumer under the Consumer Protection Act 68 of 2008 ("CPA") or any other law. If a clause conflicts with the CPA, the CPA applies.
2. Who we are
As required by section 43 of the Electronic Communications and Transactions Act 25 of 2002, here are our details:
- Full name and legal status: Sayless Logistics (Pty) Ltd, a private company registered in South Africa
- Registration number: [CIPC registration number]
- Physical address and address for service of legal documents: [Street address], Foreshore, Cape Town, 8001, Western Cape
- Telephone: 0XX XXX XXXX
- Email: hello@saylesslogistics.co.za
- Website: https://saylesslogistics.pages.dev
- Main business: road passenger transport for commuters and businesses in and around Cape Town
We operate passenger transport under the National Land Transport Act 5 of 2009 and hold or obtain the operating licences that law requires for the services we run.
3. Our services
Commuter packages
- Standard — R1 500 per month, one way: home to work, or work to home.
- Premium — R2 500 per month, two way: home to work and back home.
Each package includes legs of up to 35 km by road. Each longer leg adds its own monthly distance supplement: R45 per km per month for the distance between 35 km and 80 km, and R35 per km per month for the distance beyond 80 km. We currently operate inside the City of Cape Town; areas outside it are not yet served, and any route there would be agreed and priced separately in writing.
The price is a flat monthly fee. There is no per-trip charge and no surge pricing. Collection slots include late runs between 19:00 and 23:00 and an early 04:00 run, depending on your route.
Packages do not include weekends, public holidays, ad-hoc trips outside your booked direction, airport transfers or private hire. We can quote for these separately.
Booking, changes and skipped days
You can book, change or skip a day before the 17:00 cut-off on the day before travel. Changes after the cut-off may not be possible. Skipped days do not reduce the monthly fee, because your seat stays reserved.
Missed collections
If we fail to collect you for a booked trip, and you were at the collection point on time, we will credit that trip against your next invoice. This does not affect any other rights you have in law.
Business transport
Business clients are billed per vehicle trip against a transport plan approved by the client. The plan sets out routes, times, headcount and rates. Your separate written agreement with us prevails over these terms where they differ.
Vehicles and drivers
We decide which vehicle and driver serve each route, and may change them to keep the service running. Every driver we assign holds a valid driver's licence and Professional Driving Permit and has passed our vetting checks, and every vehicle must be roadworthy. The order of collections and drop-offs on a shared route is set by our route plan and may change as passengers join or leave.
Children and passengers needing assistance
Passengers under 18 may travel only if a parent, guardian or the business client arranging the trip has agreed this with us in writing. If you need help getting in or out of a vehicle, or travel with a mobility aid, please tell us when you book so we can plan a suitable vehicle and collection point.
4. Quotes
Prices on our website and from our savings calculator are estimates. A quote becomes binding only when we confirm it to you in writing, for example by email or WhatsApp, after checking your route. A written quote stays valid for the period it states, or 30 days if no period is stated.
5. Payment
- Commuter packages are paid monthly in advance, by the date on your invoice.
- Business clients pay by the date on each invoice, on the terms in their agreement.
- All prices are in South African rand.
- If payment is late, we may suspend your seat after letting you know, until the account is paid. We will restore the service once payment is received, if your seat is still available.
- If you think an invoice is wrong, tell us before the due date. We will check our trip records and correct any error.
We may change our prices for future months by giving you at least one calendar month's written notice. A price confirmed for a fixed term will not change during that term.
6. Cancellation by you
Month-to-month packages
You can cancel at any time by giving us written notice before the start of the next billing month. The service then ends at the end of the month you have already paid for.
Fixed-term agreements
If you are a consumer on a fixed-term agreement, section 14 of the CPA lets you cancel at any time by giving us 20 business days' written notice. You remain liable for amounts owing up to the cancellation date, and we may charge a reasonable cancellation fee, as the CPA and its regulations allow. When the fixed term ends, the agreement continues month to month unless either of us ends it.
Business clients that are not consumers under the CPA may cancel as set out in their written agreement.
Cooling-off
Where an agreement is concluded electronically and the law gives you a cooling-off right, you may cancel within the period the law allows. If you have already used the service during that time, you pay only for the trips you took.
7. Suspension or cancellation by us
We may suspend or end your service, after notice where reasonable, if:
- payment is overdue and remains unpaid after we have reminded you;
- you seriously or repeatedly break the passenger conduct rules below;
- your behaviour puts drivers or other passengers at risk, in which case we may act immediately; or
- we can no longer run your route, in which case we will give you as much notice as we can and refund any amount paid for trips we will not provide.
8. Passenger conduct
To keep every trip safe and on time, passengers must:
- wear a seatbelt for the whole trip;
- not carry or use alcohol, illegal drugs or weapons in the vehicle, and not travel while intoxicated;
- treat drivers and other passengers with respect: no harassment, violence, threats or abusive language;
- not smoke or vape in the vehicle;
- follow the driver's reasonable safety instructions; and
- be ready at the collection point at the collection time. The vehicle waits only a few minutes so that other passengers are not delayed. If you are not there, it may leave, and the trip counts as taken.
You are responsible for any damage you deliberately or negligently cause to a vehicle.
If you are travelling as a business client's staff member, we may report serious conduct issues to the person who manages your employer's account. Drivers may refuse to carry a passenger who is clearly intoxicated or who threatens anyone's safety.
9. Lost property
Please keep your belongings with you. If you leave something behind, contact us as soon as possible. We will keep items handed in to us for a reasonable time and arrange for you to collect them. We are not responsible for items left in vehicles, except where loss is caused by our negligence.
10. Delays and events outside our control
We plan routes to arrive on time, but journey times can be affected by traffic, accidents, road closures, severe weather, protest action, traffic disruption during load-shedding and other events outside our reasonable control.
We will tell you as soon as we reasonably can if a trip is significantly delayed or cannot run. We are not responsible for delays or failures caused by such events, but if we cannot provide a booked trip, it will be credited as set out above.
11. Our liability
We carry passengers with the care and skill that can reasonably be expected of a professional transport operator, and our services must meet the standards the CPA sets, including section 49 on notices of risk and section 61 on liability for harm.
To the extent the law allows, we are not liable for indirect or consequential loss, such as lost earnings because a trip was late. Nothing in these terms excludes or limits our liability for death or bodily injury, for loss caused by our gross negligence or wilful misconduct, or any liability that cannot lawfully be excluded.
12. Your privacy
We use your personal information only as explained in our Privacy Policy, which forms part of these terms. Our use of browser storage is explained in our Cookie Policy.
13. Using our website
- The savings calculator gives an estimate only. It is not a quote.
- The interactive app is a demonstration. Bookings, trips and data in it are not real and are stored only on your device.
- Website content is ours or used with permission. You may view and share it for personal use, but not copy it for commercial use without our written consent.
- Do not misuse the site, for example by sending automated or false submissions, or trying to access areas meant for staff.
- We try to keep the site accurate and available but cannot guarantee it will always be error-free or online.
- Links to other sites, such as WhatsApp, are governed by those sites' own terms.
14. Complaints
If something goes wrong, please contact us first at hello@saylesslogistics.co.za, on 0XX XXX XXXX or through our contact page. We will acknowledge your complaint promptly and try to resolve it fairly.
If we cannot resolve it, you may refer the matter to the Consumer Goods and Services Ombud (cgso.org.za) or the National Consumer Commission (thencc.org.za). Privacy complaints can go to the Information Regulator, as explained in our Privacy Policy.
15. General
- These terms are governed by the law of the Republic of South Africa.
- You and we consent to the jurisdiction of the magistrates' court for any matter that would otherwise fall within the jurisdiction of the High Court, and otherwise to the Western Cape Division of the High Court.
- Notices to us must be sent in writing to the email or physical address in section 2. We will send notices to the contact details you gave us.
- If any clause is found to be invalid, the rest of these terms still apply.
- If we do not enforce a right immediately, we have not given it up.
- We may update these terms for future bookings. We will give existing customers notice of material changes, and a change will not apply to a fixed term already agreed unless you accept it.
